Roamz Privacy Policy

General
This is the Privacy Policy for www.roamz.com.au (Website) and the ancillary Roamz mobile phone application. This Privacy Policy relates to the collection and use of your personal information that you may supply to Online Media Holdings Pty Limited (ACN 147 652 337) (Roamz, we, us and our) through your use of both the Website and the mobile phone application (Roamz Platform). Like other companies operating in Australia, we are bound by the National Privacy Principles as set out in the Privacy Act 1988 (Cth) and the Privacy Amendment (Private Sector) Act 2000 (Cth). This Privacy Policy is in addition to any other terms and conditions applicable to the Roamz Platform. We reserve the right, at our discretion, to modify or remove portions of this Privacy Policy at any time. By using the Roamz Platform, you consent to the collection and use of personal and other information by us, as set out in this policy.
Who we are
Roamz is a fun new way to find out about places and events that are going on nearby. Roamz aims to replace word of mouth as the primary way of finding out about the places to go in your area.
Our service is based upon a mobile application which harnesses the GPS capability of the users phone.
Roamz Mobile Application
At Roamz our aim is to give you, the user, suggestions about awesome places to go and things that are going on nearby. In order to do this we need to have an idea of where you are (we would rather tell you about something going on down the road than on the other side of town!). In order for you to fully utilise our services you will need to allow us to access the GPS function of your phone to determine your location. You also need to understand that this service downloads content and as such you will be responsible for any data related costs from your mobile carrier.
The Roamz mobile application has a push notification element built-in. This feature enables us to push suggestions and content to your mobile phone. We will always ask your permission to enable this function before we send you any push notifications. At any point in time if you wish to turn this service off you will be able to do so in the settings screen of the application.
Personal Information we collect
Personal information about users of the Roamz Platform is collected in order to enable us to enhance your experience and provide you with a more personalised service. We use your details including your browsing history to better tailor the service to your tastes and to provide you with suggestions that are relevant to your preferences. In saying this, the more we know about you the better the recommendations will be.
We may collect the following types of information:
Location data — Roamz allows users to 'Star' locations and receive location-base push notifications, this means that the user would like to receive an alert from Roamz when HE OR SHE IS close to a specific location or when a nearby location is active on social media. In order to provide this service Roamz needs to collect location data from the user (latitude and longitude) even when the application is not open. This data will be used for no other reason OTHER THAN to provide[d] location-based reminders to users, and will be deleted FROM off Roamz' servers every 90 days. If the user does not wish for this to happen HE OR SHE they can disable this service by selecting 'Settings' within Roamz and turning off the 'Background location' option
Information you provide—when you sign up for a Roamz account we may ask you for personal information. The type of personal information we collect includes: (a) your name; (b) your gender and date of birth; (c) your address; (d) your postcode; (e) your email address; (f) your telephone numbers; (g) your personal preferences and an account password; (h) how you use the Roamz platform, such as the date, time and location of use; and (i) information regarding your browsing activity and content uploads when using the Roamz platform.
Information provided by Facebook—We also offer the option of importing account information from third-party services (such as Facebook) to make the account creation process easy and simple. If you choose to create an account from information that is provided by a third party application (such as Facebook) you will be prompted to give Roamz authority to access this content. Please read this information at the time to make sure you are comfortable with the permissions that are being granted.
Display Name—A user’s display name by default is a combination of their first name and first initial of their surname (e.g. John Smith will be displayed as John S). Furthermore, you will be given the opportunity to add a display picture. The display picture can be captured from a third party application or if you wish to do so, you can change it in order to create a degree of anonymity. Please note that your display name and image will be viewable by all users should you post content to the Roamz Platform. If you do not wish for your photo to be made public please do not upload it or import it onto the Roamz Platform.
Your comments and uploads—The Roamz service aims to have up to date real time information regarding points of interest. You are encouraged to comment, review, like and dislike listings that are displayed through the service. Furthermore, you can upload further data such as videos and images that are related to locations. Content that is uploaded by you, including information, material, comments, views, video, photos, audio, likes etc will be made available to all Roamz users and will be attached to your display name and display picture. If you do not wish for your content to be made public please do not upload it or import it onto the Roamz Platform.
Please note that even if you chose to cancel your Roamz account or if your account is otherwise terminated by us, all of your user content may remain on Roamz even after your account has been cancelled.
When you upload content you give Roamz, in accordance with our Terms of Service, irrevocable permission irrespective of time, location or account status to use that content and make it available to all Roamz users and effectively the public at large.
Adding and Inviting Friends—Roamz makes suggestions to you based on a number of factors, one of them being the trends and opinion of your friends. As a result, we suggest that you link your Roamz account to as many pre-approved third party applications as possible. We assume that in most cases friends have similar interests. In making this assumption we assume that you will want to take part in the same activities as your friends. We therefore base our recommendations, in part, on their activities.
Third Party Services—Roamz users are able to push information to third party networks (such as Twitter, Facebook and Foursquare). In order to do this you will have to choose which third party applications you wish to link to your account. You can disconnect any third party access from Roamz at any point. If you chose to push content to these third party services the treatment of this data will also be determined by their Terms of Service and Privacy Policy.
Log information—when you use the Roamz platform, our servers automatically record information that your browser sends whenever you visit a website. These server logs may include information such as your web request, Internet Protocol (IP) address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser.
User communications—when you send emails or otherwise communicate with Roamz, we may retain those communications in order to process your inquiries, respond to your requests and improve our services.
Affiliated sites—we offer some of our services in connection with other web sites. Personal information that you provide to those sites may be sent to Roamz in order to deliver our service. We process such information in accordance with this Privacy Policy and will share information with the site on which the service is hosted. The affiliated sites may have different privacy practices and we encourage you to read their privacy policies.
Links—We may present links in a format that enables us to keep track of whether these links have been followed. We use this information to improve the quality of our search technology, and customised content.
Use of personal information
Personal information is used only for the purpose of optimising your use of the Roamz platform or for such other secondary purposes that are related to this primary purpose, unless we disclose other uses in this Privacy Policy or at the time of collection. Your personal information may be used by us for a number of purposes connected with our business operations, which include: (1) providing you with products and/or services, including information services and the display of customised content and advertising; (2) registering your details; (3) dealing with requests, enquiries, or other customer care related activities; (4) ensuring the functionality of our network; (5) carrying out auditing, market and product analysis to maintain, protect and improve our services; (6) developing new services, (7) marketing our goods and services generally; (8) contacting you about our goods and services with your consent; and (9) carrying out any activity in connection with a legal, governmental or regulatory requirement, in connection with legal proceedings and crime or fraud prevention, detection or prosecution. We may also use your personal information for purposes which are related to those described above, that would be reasonably expected by you. For example, we may use your personal information to send you marketing materials with your consent, to keep you informed about our goods and services or to conduct research in order to provide better service to you. You will be able to opt out of receiving marketing material from us when you register with us. Disclosure
We only share personal information with other companies or individuals in the following limited circumstances:
We have your consent. We require opt-in consent for the sharing of any sensitive personal information.
We provide personal information to our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such information based on our instructions and in compliance with this Policy and any other appropriate confidentiality and security measures.
We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of Roamz, its users or the public as required or permitted by law.
We may share with third parties (without notice to you) certain pieces of aggregated, non-personal information, such as the number of users who searched for a particular term, for example, or how many users clicked on a particular advertisement, or how many users access the Roamz platform via mobile phone and the like. Such information does not identify you individually.
Security
We aim to ensure the security, integrity and privacy of personal information submitted by you, and we review and update our security measures in light of current technologies. Unfortunately, no data transmission over the Internet can be guaranteed to be totally secure. However, we endeavour to take all reasonable steps to protect personal information you transmit to us. Employees and the contractors who provide services related to the Website are obliged to respect the confidentiality of any personal information held by us. However, we will not be held responsible for events arising from unauthorised access to your personal information.
We take appropriate security measures to protect against unauthorised access to or unauthorised alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorised access to systems where we store personal data.
We restrict access to personal information to our officers, employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.
Cookies
Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your browser to enable our systems to recognize your browser and tell us how and when pages in our site are visited and by how many people. Roamz cookies do not collect Personal Information, and we do not combine the general information collected through cookies with other personal information to tell us who you are or what your screen name or email address is. Most browsers have an option for turning off the cookie feature, which will prevent your browser from accepting new cookies, as well as (depending on the sophistication of your browser software) allowing you to decide on acceptance of each new cookie in a variety of ways. We strongly recommend that you leave the cookies activated as leaving them enabled will allow you to take advantage of some of our service's most attractive features. Ads appearing on the Service may be delivered to users by our advertising partners, who may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you.
Data Storage and Transfer Overseas
Some of your data is sent and stored overseas by virtue of the fact that Roamz may use the services of global companies who provide IT infrastructure such as servers. By accepting this policy you consent to the transfer and storage of your personal information in this manner. The companies that we engage to provide these services are located in countries that may have privacy laws that differ from Australia's privacy laws. In these cases we seek confirmation from the service provider that its privacy policy applicable globally is similar to Australian Privacy legislation or that it handles data in accordance with the principles set out in the US-EU safe harbour privacy network.
Business Transfers
In some cases, we may choose to buy or sell assets. In these types of transactions, customer information is typically one of the business assets that are transferred. Additionally, if Roamz were acquired by another entity for whatever reason, customer information would be one of the assets that is acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Roamz may continue to use your personal information as set out in this policy.
Access to information
We will endeavour to take all reasonable steps to keep secure any information which we hold about you, and to keep this information accurate and up to date. Except in relation to emergencies or law enforcement matters, we will also provide you with access to your personal information that we hold. If, at any time, you discover that information held about you is incorrect, you may contact us to have the information corrected.

We provide links to websites outside our own Website. These linked sites are not under our control, and we cannot accept responsibility for the conduct of third parties linked to our Website. Before disclosing your personal information on any other website, we advise you to examine the terms and conditions of using the website and its privacy statement.

You should always sign-out or close your browser once you have finished your session. This is to ensure that others cannot access your personal information and correspondence. Please note that this Privacy Policy may change from time to time. Each version of this Privacy Policy will be identified at the top of the page by its effective date, and we will also keep prior versions of this Privacy Policy in an archive for your review.
